: (1) According to section 145 of the Act, if an establishment whose number of workers has been reduced for any reason comes back into operation within two years, or if workers need to be added to an establishment where workers have been reduced, such establishment must give at least fifteen days notice to the workers who have been reduced and call them to work. .
(2) The notice as per sub-rule (1) shall be published and broadcast in national level newspapers and electronic media and kept on the website of the Ministry and the institution for at least fifteen days.
(3) According to the notice published in accordance with sub-rule (1), the establishment may select the workers who come in contact with the establishment on the basis of their qualifications, experience, work capacity, etc. and employ them in the required number.
(4) Notwithstanding anything written in sub-rule (3), if the establishment is unable to carry out the work with old workers due to the installation of new technology or changes in the production process, or if it is not possible to employ old workers due to the age and physical condition of the workers, by selecting new workers. There will be no hindrance to work.
